About these Terms

Blacksteel Photography is a trading name used by Ben Wood, operating as a sole trader. These Terms & Conditions apply to photography, videography, drone, creative content and brand strategy services supplied by Blacksteel Photography.

The quotation, agreed project scope and these Terms together form the agreement with the client. Project-specific wording in an accepted quotation takes priority where it expressly differs from these general Terms.

The client should read these Terms before accepting a quotation or paying a booking deposit. Nothing in these Terms removes or restricts rights that cannot lawfully be excluded.

​

1. Booking & Payment

Quotations and project scope

​

A quotation is based on the information available when it is issued and is normally valid for 30 calendar days. It will describe the agreed services, deliverables, intended usage, price and any known travel, equipment, crew, licensing or third-party costs.

​

An enquiry or provisional date does not create a booking. Unless another arrangement is agreed in writing, a booking is confirmed only when the client accepts the quotation and Blacksteel Photography receives the required 25% booking deposit.

​

The client must check the quotation and promptly identify anything inaccurate or missing. Work outside the agreed scope, including extra locations, additional deliverables, extended attendance, specialist equipment, extra crew, permissions, travel, accommodation, props or licensing, may be quoted and charged separately.

​

Deposit and invoices

​

The 25% deposit reserves the agreed date and allows planning and pre-production to begin. The remaining 75% is due before final delivery, unless the quotation states a different payment schedule.

​

Invoices are payable within 14 calendar days of the invoice date or by any earlier project deadline clearly stated on the invoice or quotation. Proofs may be supplied for approval before final payment, but clean, unwatermarked or unrestricted final files may be withheld until all sums due for the project are paid.

​

Expenses and changes

 

The client is responsible for approved external costs incurred specifically for the project, including venue fees, permits, parking, transport, accommodation, hired equipment, crew, props and third-party licences. Where practical, these will be identified in advance. Non-refundable external costs already committed remain payable.

​

If the client requests a material change after accepting the quotation, Blacksteel Photography may revise the price, deposit, delivery estimate and scope. No additional work is required until the change is agreed in writing.

​

Late payment

​

Blacksteel Photography may pause work, withhold delivery, suspend a usage licence or refuse further bookings while an invoice is overdue. Any resulting delay will extend the delivery schedule.

​

For qualifying business-to-business debts, Blacksteel Photography reserves the right to charge statutory interest and to recover compensation and reasonable recovery costs permitted by the Late Payment of Commercial Debts (Interest) Act 1998 and any replacement or amending legislation.

​

Any disputed invoice item should be raised promptly and in good faith. The undisputed part remains payable by its due date.

​

2. Cancellation & Rescheduling

Cancellation by the client

​

If the client cancels after the booking is confirmed, the 25% booking deposit will normally be retained to reflect the date reserved, planning undertaken and booking opportunity lost. This is subject to Section 16 and any statutory consumer cancellation rights. Blacksteel Photography will not retain more than is lawful and reasonable in the circumstances.

​

The client must also pay for work already completed and any reasonable, non-refundable external costs already committed with the client's approval. Where those sums exceed money already paid, Blacksteel Photography may issue a balancing invoice.

​

Rescheduling by the client

​

The client may request a new date by giving as much notice as reasonably possible. A change is not confirmed until Blacksteel Photography accepts the replacement date in writing. Availability cannot be guaranteed.

​

The existing deposit may normally be transferred to a replacement date. After three client-requested reschedules, Blacksteel Photography may require a further 25% deposit before reserving another date. Additional costs caused by the change, including venue, travel, crew or hire charges, remain payable by the client.

​

Cancellation or rescheduling by Blacksteel Photography

​

If illness, emergency, equipment failure or another serious issue means Blacksteel Photography cannot attend, it will first offer a reasonable replacement date, suitable substitute or adapted service. If no reasonable alternative can be agreed, the client may cancel the affected service and receive a full refund of sums paid for work not provided, including the deposit for that affected booking.

Sessions ended early

​

If the client, venue or a person acting for the client ends a session early, arrives late, restricts agreed access or prevents completion for a reason not caused by Blacksteel Photography, the agreed fee remains payable. Blacksteel Photography will still deliver any usable work reasonably captured.

​

Weather and drone-related changes are handled under Sections 3 and 4. Events outside either party's reasonable control are handled under Section 14.

​

3. Weather & Outdoor Shoots

​

Outdoor work depends on safe and suitable conditions. Blacksteel Photography has the final decision on whether weather, light, ground conditions, access or another environmental factor makes the planned work unsafe, unlawful or unlikely to achieve a professionally usable result.

​

Blacksteel Photography may reasonably delay, pause, adapt, shorten, relocate, stop or reschedule outdoor work. Possible adaptations include changing the route, location, timing, shot plan or use of equipment.

​

Where a weather-related reschedule is reasonably necessary, no additional creative fee will be charged merely for moving the booking. The client remains responsible for non-refundable travel, accommodation, venue, permit, crew, hire or other external costs already incurred.

​

Unless expressly included in the quotation, the client is responsible for securing permission to enter and work at the chosen location and for checking any venue rules. Public access does not necessarily grant permission for commercial photography, filming, lighting, tripods or drone take-off and landing.

​

If the client asks to proceed despite advice about poor conditions, and Blacksteel Photography considers it safe and lawful to do so, the client accepts the reasonably foreseeable limitations in light, sound, comfort, continuity and image quality. This does not reduce Blacksteel Photography's duty to use reasonable care and skill.

​

4. Drone Operations

​

Drone work will only be undertaken where it can be carried out safely, legally and within the capabilities of Blacksteel Photography's available aircraft and qualifications. The current operational setup is a sub-250g DJI Mini 3.

​

Legal and safety control

​

The remote pilot has final authority over every flight. Blacksteel Photography may refuse, delay, alter or stop a flight because of weather, airspace restrictions, people, crowds, buildings, wildlife, emergency activity, signal conditions, take-off or landing risks, privacy concerns, equipment condition or any other legal or safety issue.

​

Flights will remain within the applicable UK Open Category rules unless a different lawful operation is expressly agreed.

​

The aircraft will be kept in direct visual line of sight and will not be flown over crowds.

​

Applicable height limits, restricted airspace, geographical zones and CAA requirements will be observed.

​

Required Operator ID, Flyer ID and compliant third-party commercial drone insurance must be current before paid flight operations.

​

Permissions and access

​

Unless otherwise agreed, the client is responsible for obtaining permission from the landowner or controller for access and for take-off and landing. The client must disclose relevant site restrictions, security requirements, hazards and known sensitivities. Blacksteel Photography remains responsible for the flight decision and cannot be required to fly merely because land access has been granted.

​

If the drone cannot fly

​

Drone footage is not guaranteed unless the quotation expressly makes it an essential deliverable and lawful, safe flight remains possible. If a flight cannot proceed, Blacksteel Photography may try later, rearrange the drone element, capture suitable ground-based alternatives or adjust the final edit.

​

Where the drone element cannot be supplied at all, any price adjustment or refund will reflect the value of that specific undelivered element, less completed work and reasonable non-refundable costs. Failure to fly does not automatically cancel unrelated photography, filming or editing services.

​

5. RAW Files & Project Files

​

Unless expressly included in the quotation, the client receives only the selected, edited and exported final deliverables. RAW photographs, unedited footage, rejected takes, audio originals, timelines, project databases, graphics source files, colour-grading files, templates and other working materials are not included.

​

Selection is part of the creative service. Blacksteel Photography may exclude duplicates, test shots, technical failures, unflattering frames, incomplete recordings and material that does not meet the intended standard.

​

RAW or project files may be supplied only under a separate written agreement and may require an additional fee, storage media, data transfer arrangements and a specific licence. Delivery of source material does not transfer copyright unless a signed written copyright assignment expressly says so.

​

Blacksteel Photography may retain working files and backups for a reasonable operational period but does not promise permanent archiving. Files may be deleted after final delivery, project closure or when storage is no longer reasonably required. The client is responsible for promptly downloading and securely backing up final deliverables.

​

If Blacksteel Photography still holds archived material, later retrieval, reconstruction, re-editing, conversion or re-uploading may be charged separately. Recovery cannot be guaranteed.

​

6. Liability, Safety & Safeguarding

​

Reasonable care and unavoidable limitations

​

Blacksteel Photography will perform the agreed services with reasonable care and skill. Creative services can be affected by weather, lighting, venue restrictions, participant behaviour, technical compatibility, third-party platforms and other circumstances that cannot always be controlled.

​

If a technical failure, accidental loss or other problem for which Blacksteel Photography is responsible prevents delivery, its first response may include repair, recovery, re-editing, replacement audio, a reasonable reshoot or a proportionate refund. The appropriate remedy will depend on what is practical and on the part of the service affected.

​

Limits that apply where lawful

​

Blacksteel Photography is not responsible for indirect or unforeseeable loss, loss caused by inaccurate client instructions, unauthorised client alterations, third-party platforms, or a client's failure to download, back up or use the work within the agreed licence.

​

For business clients only, and so far as the law permits, Blacksteel Photography's total liability arising from a project will not exceed the total fees paid or payable for that project. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded.

​

Consumer rights and remedies under the Consumer Rights Act 2015 and other applicable law are not restricted.

​

Safety and conduct

​

Blacksteel Photography may stop or refuse work where behaviour, access, instructions or conditions create a safety, legal, harassment, abuse or safeguarding concern. The client must provide a reasonably safe working environment, follow lawful safety instructions and tell Blacksteel Photography about known hazards.

​

The client is responsible for the conduct of its guests, staff, contractors and attendees. Deliberate or negligent damage to equipment caused by the client or a person for whom the client is responsible may be charged at the reasonable repair or replacement cost.

​

Children and adults at risk

​

A parent, guardian, responsible adult or authorised representative must remain responsible for children and adults at risk throughout the work. Blacksteel Photography does not take over supervision, childcare, pastoral or safeguarding duties.

​

For schools, nurseries, youth groups, care settings and similar organisations, the commissioning organisation must identify anyone who must not be photographed or filmed, confirm the lawful basis and permissions for the commissioned activity, and communicate its safeguarding procedures. Blacksteel Photography will follow reasonable site procedures that are disclosed in advance.

​

7. Copyright, Licensing & Usage

​

Ownership

​

Unless a separate written assignment states otherwise, copyright in photographs, films, edits, graphics and other original work created by Blacksteel Photography remains with Blacksteel Photography. Paying for a commission purchases the agreed service and usage licence; it does not automatically transfer copyright.

​

Any full transfer of copyright must be separately negotiated, clearly recorded in writing and signed by or on behalf of Blacksteel Photography. It may require an additional fee. Moral rights and rights that cannot be assigned are preserved.

​

Licence granted to the client

​

Once all sums due are paid, the client receives a non-exclusive, non-transferable licence to use the delivered final work for the purposes, platforms, territory and duration stated in the quotation. If the quotation is silent, the following applies:

​

• Personal clients may use the delivered work for private, personal and non-commercial use, including ordinary personal social-media sharing.

• Business and organisational clients may use the delivered work to promote their own organisation on their websites, owned social-media channels, presentations, printed materials and ordinary online marketing.

• The licence applies only to the delivered final work and does not include RAW files, rejected material, project files or separately licensed third-party assets.

 

The client may crop, resize or reformat work where reasonably necessary for an agreed platform, provided this does not misrepresent, materially distort or damage the work or Blacksteel Photography's reputation.

​

Uses requiring written permission

​

Unless expressly included in the quotation, the client must not:

• sell, sublicense, assign or commercially supply the work to another person or organisation;

• claim authorship or remove a required copyright or attribution notice;

• use the work for another brand, campaign, product, client or purpose beyond the agreed licence;

• apply substantial edits, filters, compositing, artificial-intelligence alterations or audio replacements that materially change the work;

• use the work in templates, stock libraries, merchandise, resale products, broadcast, cinema or other separately licensed media; or

• extract, copy or reuse third-party music, sound effects, fonts, stock assets or other licensed elements independently.

 

Third-party use and contributors

​

A client may provide final work to a printer, publisher, platform, venue or contractor only to the extent reasonably necessary to exercise the client's own agreed licence. That recipient receives no independent ownership or reuse right.

​

The client is responsible for obtaining permissions for logos, artwork, scripts, music, products, locations and other material it supplies. The client confirms that Blacksteel Photography may use those materials for the agreed project and will be responsible for claims caused by materials or instructions supplied without the necessary rights.

​

Misuse and correction

​

If the work is used outside the licence, unlawfully altered, misleadingly attributed or used in a way reasonably likely to damage Blacksteel Photography's reputation, Blacksteel Photography may require the affected material to be removed, replaced or corrected within seven days of written notice. Immediate removal may be required for unlawful, offensive, dangerous or seriously reputational use.

​

If a breach is not corrected, Blacksteel Photography may suspend or terminate the licence for the affected work and take reasonable steps to protect its rights. Corrective editing, replacement exports and additional licensing may be charged separately.

​

Credit and exclusivity

​

Credit is appreciated but is not required unless the quotation says otherwise. All licences are non-exclusive unless written exclusivity is purchased. Copyright ownership, exclusivity, competitor restrictions and limits on portfolio use must be agreed separately and may affect the fee.

​

8. Music Licensing & Publication Clearance

​

Where a completed video contains music, sound effects or other audio licensed from a third-party provider, the client's use remains subject to the applicable provider licence. Licensed audio is supplied only as part of the completed production.

The client must not extract, distribute, resell or reuse licensed audio separately or place it in another production.

​

Intended use

​

Before publication, the client must tell Blacksteel Photography where and how the video will be used, including websites, social platforms, channels, paid digital advertising, public displays, events, streaming, broadcast, cinema or other distribution.

​

The standard music licence may cover commercial online content and online advertising but not every use. Television, cinema, television advertising, radio, games, applications, live events, physical venues or other offline uses may require a different provider plan or separate licence. Additional licensing and administration costs are payable by the client where agreed.

​

Publication and clearance process

​

Where safelisting or link clearance is required, the client must cooperate and provide every link, account, channel or other detail reasonably requested. Unless another process is agreed, the client must:

​

• upload the completed video to each intended platform using an unlisted, private or otherwise non-public setting where available;

• send the direct link for each upload to Blacksteel Photography;

• allow reasonable time for the link to be cleared while the relevant music subscription or licence remains active; and

• wait for Blacksteel Photography's written clearance confirmation before making the video public.

 

Blacksteel Photography may instead send an authorised clearing invitation. The client must complete it within the stated deadline and while the relevant subscription permits it. A video first published after the applicable subscription or licence period ends may not be covered.

​

Further uploads and changes

​

Clearance of one link does not automatically clear every later upload, channel, account, advertisement or platform. The client must notify Blacksteel Photography before a new upload, paid campaign, third-party publication, broadcast, public exhibition or substantial change to the video or audio.

​

Claims and platform notices

​

Automated copyright claims can occur even where audio is properly licensed. The client must promptly provide the claim, screenshot, link and platform details and should avoid removing, disputing or altering the content until Blacksteel Photography has had a reasonable opportunity to investigate, unless the platform requires immediate action.

​

Blacksteel Photography will provide reasonable assistance for a claim relating to audio it supplied for the agreed use. It is not responsible for consequences caused by premature publication, missed deadlines, undisclosed platforms or accounts, out-of-scope use, client alterations, separate audio reuse or actions taken without approval.

​

If Blacksteel Photography made the relevant licensing or clearance error, it will take reasonable steps to correct the clearance, replace the audio or provide another fair and proportionate remedy.

​

9. Portfolio & Public Use

​

Business and commercial work

​

Unless otherwise agreed in writing before the project begins, Blacksteel Photography may use selected completed business or organisational work for its website, portfolio, social-media accounts, printed promotion, advertisements, proposals, presentations, exhibitions, competitions and professional showcases after:

​

• the client has published or publicly released the work;

• the relevant campaign, product or service has launched; or

• any agreed confidentiality period or publication embargo has ended.

 

Blacksteel Photography will not intentionally reveal unreleased campaigns, confidential information or commercially sensitive material before the client makes it public or gives written approval.

​

A business client may request that some or all work is excluded. Confidentiality, exclusivity or portfolio restrictions must be agreed in writing before the project begins and may affect the quotation where they limit Blacksteel Photography's ability to display the work.

​

Personal and domestic work

​

Photography or video commissioned for personal or domestic purposes will not be used publicly without separate, explicit permission. This includes family and individual portraits, pet photography, personal documentary films, private celebrations and other work primarily commissioned for private use.

​

Portfolio permission is separate from acceptance of these Terms and is not a condition of booking. Where permission is granted, Blacksteel Photography may use only selected final material for the purposes described when permission was obtained.

​

Children, schools and adults at risk

​

Identifiable images or footage of children or adults at risk will not be used publicly unless clear written approval has been provided by the client, school, venue or commissioning organisation and the required permissions and safeguarding process have been confirmed. For schools, nurseries and youth groups, specific approval is required for the particular material intended for publication.

​

Confidential and sensitive material

​

Blacksteel Photography will respect agreed non-disclosure terms, embargoes and written restrictions. It will not knowingly publish private addresses, restricted areas, security information, personal information not intended for publication or material whose publication could reasonably place a person at risk.

​

Withdrawal and removal

​

Where personal or domestic work is used based on consent, the client may withdraw consent for future use in writing. Blacksteel Photography will remove the affected material from channels under its direct control within a reasonable period.

​

Blacksteel Photography cannot guarantee recall of printed materials already produced, archived business records, or copies already downloaded, shared or republished by third parties. Reasonable commercial removal requests will be considered in good faith, but removal is not automatic where valid contractual portfolio use was agreed unless continued use would breach law, confidentiality or an agreed restriction.

10. Creative Control, Proofs & Revisions

​

The client chooses Blacksteel Photography for its creative judgement and style. Unless the quotation states otherwise, Blacksteel Photography retains creative control over image and footage selection, editing, retouching, colour grading, sound design, music, pacing, structure, storytelling and the final visual treatment.

​

Proofs

​

Video clients will normally receive a draft or proof. Photography clients may receive watermarked proofs where selection or approval is needed. Proofs are for private review only and must not be published, publicly shared, screen-recorded, captured, altered or used as final content.

​

After approval and full payment, Blacksteel Photography will supply the agreed finished files without proof watermarks or review restrictions.

​

Included revisions

​

Unless the quotation states otherwise, video, graphics and strategy work includes up to three revision rounds. The client must provide one clear, combined set of feedback within three calendar days of each proof or revised version.

​

A revision means a reasonable change to the existing agreed work. Photography includes reasonable correction where something was genuinely missed or incorrectly edited, but does not include repeated changes of taste or a wholesale change of style.

​

A fourth or later revision round, fragmented feedback, major concept changes, new deliverables, changes to approved content, or work outside the original scope may be charged separately. Reshoots caused by a client changing its mind, supplying inaccurate information or departing from the agreed plan are not included.

​

Blacksteel Photography is not required to implement feedback that is unlawful, technically impractical, outside the licence, unsafe, misleading or seriously inconsistent with the agreed professional standard. It will explain material concerns and propose a reasonable alternative where possible.

​

11. Delivery & Client Delays

​

The quotation will give an estimated delivery timeframe. Delivery dates are estimates rather than guarantees unless a fixed deadline is expressly accepted in writing. Project complexity, rendering, technical problems, licensing, illness and third-party delays can affect timing.

​

Client delays in supplying information, access, assets, permissions, selections, approvals, payment or consolidated feedback will extend the delivery schedule. Scope changes may require a revised estimate.

​

Proofs may be supplied before final payment. Clean, unwatermarked and unrestricted final work is released after approval and full payment, subject to any agreed staged delivery plan.

​

Final files may be delivered through Google Drive or another suitable online service. Links will normally remain available for at least 30 days and may remain active for longer, but permanent online hosting is not promised. The client must promptly download and securely back up all deliverables.

​

If a copy is still retained later, Blacksteel Photography may re-upload it, but retrieval, conversion or reconstruction may carry a reasonable fee. Availability cannot be guaranteed.

​

The client must inspect delivered files promptly and report apparent corruption, missing agreed deliverables or technical faults as soon as reasonably possible. This does not reduce statutory rights.

​

12. Brand Strategy & Repeat Business Services

​

Brand strategy, creative direction and business content services may be commissioned as one-off projects. A client may return monthly or regularly, but each new piece of work is treated as a separate project with its own agreed scope, quotation, payment arrangement and estimated delivery.

​

There is no automatic subscription, monthly charge, retainer, renewal or obligation to book another project unless a particular quotation or separate written agreement expressly creates one.

​

Blacksteel Photography provides professional creative recommendations but does not guarantee sales, followers, reach, engagement, enquiries, profit, search ranking or business growth. The client remains responsible for business decisions and for deciding whether to follow recommendations.

​

Blacksteel Photography creates and delivers content for the client to publish and manage. It does not access, operate or manage the client's social-media accounts unless that separate service is expressly agreed in writing.

​

The client is responsible for the accuracy and legality of prices, offers, dates, product information, claims, testimonials, promotions and other business information it supplies or approves. Blacksteel Photography is not responsible for errors based on inaccurate client information or for platform algorithms, outages, policy changes, account restrictions or content removal outside its reasonable control.

​

13. Assistants & Subcontractors

​

Blacksteel Photography may use a suitably skilled assistant, second shooter, editor, sound specialist, drone specialist or other contractor where reasonably necessary to deliver the project, cover an emergency or meet technical requirements.

​

Blacksteel Photography remains responsible for the agreed service and will require people working under its direction to respect appropriate confidentiality, data protection, safety and safeguarding requirements.

​

Where a named individual or specialist is essential to the project, that requirement must be recorded in the quotation. A reasonable substitute may otherwise be used where necessary.

​

14. Events Outside Reasonable Control

​

Neither party is responsible for delay or failure caused by an event outside its reasonable control, including serious illness, accident, bereavement, extreme weather, transport disruption, power or network failure, equipment supply failure, venue closure, industrial action, government action, civil emergency, natural disaster or a similar event.

​

Affected obligations will be paused for as long as reasonably necessary. Both parties will first try to rearrange, delay, relocate, substitute or adapt the affected work.

​

If the event continues for more than 30 days or makes the affected service impractical, either party may end the affected part by written notice. The client will receive an appropriate refund for services not provided, less the value of completed work and reasonable non-refundable costs.

​

This section does not excuse payment for work already completed or costs already properly committed, and it does not restrict any non-excludable consumer remedy.

​

15. Complaints & Disputes

​

A client should raise any concern as soon as reasonably possible and preferably within 14 days of delivery, giving enough detail and supporting material for Blacksteel Photography to investigate. That preferred period does not remove statutory rights.

​

Both parties will first try in good faith to resolve the issue directly. Depending on the issue, a fair response may include explanation, correction, re-editing, replacement, reshoot, price reduction or proportionate refund.

​

If direct discussion does not resolve the dispute, the parties may consider an appropriate independent mediation process before court proceedings. This does not prevent either party from seeking urgent relief or using a legal right that cannot be delayed.

​

These Terms and each project agreement are governed by the laws of England and Wales. The courts of England and Wales will have jurisdiction, subject to any mandatory consumer right to bring proceedings elsewhere.

​

16. Consumer Cancellation Rights

​

This section applies to a consumer: an individual booking mainly for purposes outside their trade, business, craft or profession. It does not normally apply to a company or a person booking wholly for business purposes.

​

Where a consumer contract is made online, by email, by telephone or away from Blacksteel Photography's business premises, the consumer will normally have the right to cancel without giving a reason during the 14-day cancellation period beginning on the day after the contract is made.

​

The consumer may cancel by any clear written statement, including email, or may use the model form in Appendix A. The cancellation is effective when the communication is sent.

​

Work requested during the 14-day period

​

Blacksteel Photography will not begin the service during the cancellation period unless the consumer expressly requests an early start. The consumer may use the wording in Appendix B or give another clear written request.

​

If the consumer requests an early start and then cancels before the service is fully completed, Blacksteel Photography may charge a proportionate amount for work supplied up to cancellation and any properly disclosed, non-refundable cost incurred at the consumer's request.

​

If the service is fully performed during the cancellation period after the consumer expressly requested early performance and acknowledged that the cancellation right would be lost on full performance, the right to cancel ends when the service is fully performed.

​

Refunds

​

Where a valid statutory cancellation is exercised, Blacksteel Photography will refund sums due without undue delay and normally within 14 days after being informed. The refund will use the original payment method unless another method is agreed and will be reduced only where the law permits.

​

If Blacksteel Photography fails to provide the legally required cancellation information, the cancellation period may be extended as provided by law.

​

The ordinary deposit and cancellation provisions in Section 2 do not override this section or any other mandatory consumer protection.

​

17. Acceptance & General Terms

Forming the agreement

​

Submitting an enquiry does not create a confirmed booking. Before confirmation, the client will be provided with these Terms and the relevant quotation, proposal or project details. Unless another arrangement is agreed, the agreement is formed when the client accepts the quotation and pays the 25% booking deposit.

The client may accept by:

​

• ticking the required website acceptance box;

• signing or electronically accepting a quotation or agreement;

• confirming acceptance by email or another written electronic message; or

• paying the booking deposit after receiving the quotation and these Terms.

 

By confirming the booking, the client confirms that they have read and agreed to these Terms, the accepted quotation and project scope, the payment schedule, any project-specific written conditions and the Blacksteel Photography Privacy Notice.

A person booking for a business, school, charity, venue, organisation or another individual confirms that they have authority to accept on that party's behalf.

Priority and changes

​

The quotation, agreed scope and these Terms form the agreement. A clear project-specific term in the quotation takes priority over an inconsistent general term for that project. Changes to services, price, usage, timing or another important term must be agreed in writing.

Notices and written agreement

​

References to 'in writing' include email and other written electronic messages that can be saved. Notices should be sent to the contact details used for the booking, with notices to Blacksteel Photography sent to contact@blacksteelphotography.co.uk.

Severability, waiver and third parties

​

If a term is found invalid or unenforceable, it will be adjusted or removed only to the minimum extent necessary and the remaining terms will continue. A delay in enforcing a right does not waive it. No person other than Blacksteel Photography and the client may enforce the agreement unless the agreement expressly says otherwise.

Entire agreement and version

​

The agreement records the understanding about the project and replaces earlier discussions about the same subject, without excluding liability for fraud. The version applying to a booking is the version supplied or made available when that booking is confirmed. Later updates do not retrospectively change an existing agreement unless both parties agree.

For remote bookings, Blacksteel Photography will provide confirmation and a copy of the applicable Terms in a durable format that the client can save, such as a PDF attached to an email.

​

Nothing in these Terms affects statutory rights or requires a client to accept a term that would be unfair or unlawful.

Consumer cancellation form

If you are a consumer and have a statutory right to cancel your booking, you may use the Model Cancellation Form included in the downloadable PDF version of these Terms & Conditions. You are not required to use the form and may also cancel by sending Blacksteel Photography a clear written statement by email.
